10 pitfalls for manufacturers entering the US market
The mistakes we see most often — each one has cost someone an order. Want it as a PDF? Email us and we'll send it.
North American buyers want a US company to contract with, a US phone number and replies in their working day. A factory email alone loses deals before a quote is sent.
Buyers compare delivered prices. Duties depend on the HTS code and the country of origin; some origins pay extra duties (for example Section 301 on many goods from China), and rates change often.
The $800 de minimis duty exemption has been suspended for commercial shipments from every country, so even small parcels now pay duty. Price it in.
In the US, words decide the category. A cosmetic that says “antibacterial”, “heals” or “stops sweat” is regulated as a drug. Equipment marketing has its own limits.
Cosmetic facilities must register with FDA and list products under MoCRA; other categories answer to other agencies (FCC, CPSC, EPA). Find out which apply before the first shipment.
Equipment used in US workplaces is generally expected to carry a mark from a Nationally Recognized Testing Laboratory such as UL, ETL or CSA. Many buyers won’t install without it.
Products sold in California may need a Prop 65 warning if they contain listed chemicals above safe-harbor levels. Retailers will ask.
A growing list of states restricts intentionally added PFAS in cosmetics and other products, with different dates in each state.
Register your brand with the USPTO before you launch. Applicants based outside the US must use a US-licensed attorney, and Amazon Brand Registry needs a trademark.
Amazon ended its US FBA prep and labeling service on January 1, 2026. Inventory must arrive labeled, bagged and dated, or it gets rejected or charged.
- USTR — Section 301 tariff actions
- Thompson Coburn — De minimis exemption suspended for commercial shipments
- FDA — Is it a cosmetic, a drug, or both?
- FDA — Modernization of Cosmetics Regulation Act (MoCRA)
- OSHA — Nationally Recognized Testing Laboratory program
- California OEHHA — Proposition 65 warnings
- LuxeFormula Labs — PFAS in cosmetics: state bans
- USPTO — Foreign-domiciled applicants need a US-licensed attorney
- Amazon — US FBA prep and labeling services end January 1, 2026

Questions from manufacturers
What does Sheridan Hub do for a manufacturer?
We build and run a North American brand around your product: English website and search presence, inquiries and quotes in English, claims and label review, documentation, and after-sales coordination, selling through a US company.
Which countries do you work with?
Manufacturers anywhere. What matters is the product and its documents, not where the factory is. We currently publish this page in English, Chinese, Spanish, Vietnamese and Turkish.
Do you buy our products?
It depends on the model. We work as an agent, as a distributor, or by building a brand together with you. Terms depend on the category and are agreed in writing after we review your product.
Which products are a good fit?
Specialty, B2B or technical products where buyers need documents and answers before they order: equipment, materials, private-label consumer goods. We are not a fit for commodity products competing only on price.
Do we need our own US company?
No. Sales can run through our US company. You keep making the product; we handle the North American side.
